1. Introduction

1.1 General

These Terms of Use ("Terms") govern your access to and use of Wall Walkers Bouldering's website, facilities, services, and products. Wall Walkers Pty Ltd., trading as Wall Walkers Bouldering ("Wall Walkers," "we," "us," or "our"), operates an indoor bouldering facility located at 6 Jones Rd Capalaba QLD 4157.

Terms constitute a legally binding agreement between you and Wall Walkers Bouldering, subject to the Australian Consumer Law and relevant Queensland legislation. By accessing our website, using our services, or entering our facility, you acknowledge that you have read, understood, and agree to be bound by these Terms, including any additional guidelines, policies, and future modifications.

We reserve the right to change these Terms at any time, subject to applicable laws and regulations. Any changes will be effective immediately upon posting on our website.

2. Acceptance of Terms

2.1 General Acceptance

By accessing our website, entering our facilities, participating in any activities, or using our services, you expressly acknowledge and agree to be bound by these Terms and any guidelines, policies, and waivers referenced herein, subject to your rights under the Australian Consumer Law. This includes, but is not limited to:

  • Facility rules and safety procedures
  • Class and program-specific policies

2.2 Non-Acceptance

If you disagree with any part of these Terms, subject to your non-excludable rights under the Australian Consumer Law, you must not:

2.3 Users Under 18

In accordance with Queensland law and the Age of Majority Act 1974 (Qld):

  • A parent or legal guardian must accept these Terms on behalf of any person under 18 years of age
  • The parent or legal guardian assumes full responsibility for ensuring their minor's compliance with these Terms
  • The parent or legal guardian must physically accompany minors under 14 years of age while at our facility
  • The parent or legal guardian accepts full liability for any damages or injuries resulting from their minor's use of our facilities

2.4 Violation of Terms

Wall Walkers Bouldering reserves the right, subject to compliance with the Australian Consumer Law and Queensland Fair Trading Act 1989, to:

  • Deny access to our facilities
  • Terminate memberships
  • Cancel bookings
  • Refuse service to anyone who violates these Terms or engages in conduct that we determine to be inappropriate or harmful to our community

3. Definitions

In these Terms, unless the context otherwise requires or is inconsistent with the Australian Consumer Law or other applicable legislation:

"Activities" refers to any and all forms of climbing activities conducted at our facility, including but not limited to climbing, rock climbing, bouldering, indoor climbing, slacklining, and the usage of hang boards, crimp ladders, and other rock climbing or training equipment.

"Australian Consumer Law" means Schedule 2 of the Competition and Consumer Act 2010 (Cth) and any equivalent State or Territory legislation.

"Facility" refers to the physical premises located at 6 Jones Rd Capalaba QLD 4157, including all equipment, fixtures, fittings, and amenities contained therein.

"Services" refers to all services provided by Wall Walkers Bouldering, including but not limited to climbing access, classes, instruction, equipment rental, retail sales, coaching, training, and any other services offered by Wall Walkers Bouldering from time to time.

"Member" refers to any person who has purchased a membership with Wall Walkers Bouldering, whether that membership is active, suspended, or pending activation.

"Visitor" refers to any person who enters our facility, whether as a casual user, guest, spectator, or for any other purpose.

"Staff" refers to any employee, contractor, agent, or representative of Wall Walkers Bouldering who is authorized to act on behalf of Wall Walkers Bouldering.

"Terms" refers to these Terms of Use, including any amendments, modifications, or supplementary terms that may be added from time to time.

"Waiver" refers to the liability waiver and risk acknowledgment forms that must be completed by all persons prior to participating in any Activities.

4. Facility Access and Usage

4.1 Operating Hours

Our standard operating hours are published on our website's Contact page, in compliance with Queensland trading hours legislation. These hours are subject to change, and any modifications will be posted on our website with reasonable notice. Members with 24-hour access privileges may access the facility outside of standard operating hours in accordance with their membership terms.

4.2 Membership and Casual Entry

4.2.1 Access Rights:
Wall Walkers Bouldering offers various membership options and casual entry passes, details of which are available at our facility and on our website. Wall Walkers Bouldering reserves the absolute right to refuse entry to any person at its discretion.

4.2.2 Membership Terms:

All memberships are personal and non-transferable. Members may not loan their access cards or permit others to use their membership privileges under any circumstances.

4.2.3 Membership Changes:
Membership suspension and cancellation terms are specific to each membership type and are detailed in the relevant membership agreement. All membership changes must be submitted in writing with the required notice period.

4.3 Safety Requirements

4.3.1 Mandatory Safety Briefing:
Prior to engaging in any climbing activities, all first-time visitors must complete a mandatory safety briefing conducted by Wall Walkers Bouldering staff.

4.3.2 Facility Use Requirements:
All persons using the facility must:

  • Comply with all posted rules, signs, and staff instructions at all times
  • Use safety equipment appropriately and in accordance with manufacturer specifications
  • Report any hazards, incidents, or safety concerns immediately
  • Not engage in any behavior that may compromise their safety or the safety of others

4.3.3 Competency Assessment:
Wall Walkers Bouldering reserves the right to require any person to demonstrate their competency in safety procedures at any time.

5. Risk Acknowledgment and Waivers

5.1 Inherent Risks

5.1.1 Risk Acknowledgment:
In accordance with the Civil Liability Act 2003 (Qld) and subject to the Australian Consumer Law, the Activities offered by Wall Walkers Bouldering are, by their nature, dangerous activities that involve inherent risks. These risks include, but are not limited to, the risk of serious physical injury, psychological trauma, disability, and death.

5.1.2 Specific Risk Disclosure:
By participating in any Activities at Wall Walkers Bouldering, you acknowledge and accept that climbing, bouldering, and related activities can result in:

  • Panic attacks and anxiety responses
  • Hyperventilation and respiratory distress
  • Cardiovascular events including heart attacks
  • Musculoskeletal injuries including fractures and hyperextension
  • Cuts, abrasions, and other soft tissue injuries
  • Other injuries or health conditions as outlined in our risk assessment documentation

5.1.3 Activity-Specific Risks:
Significant risks include, but are not limited to:

  • Uncontrolled falling and impact injuries
  • Collision with objects, equipment, or structures
  • Collision with other participants
  • Impact with climbing walls and holds
  • Contact with unprotected floors or surfaces
  • Stress or overuse injuries from improper technique or exercise strain

5.2 Waiver Requirements

5.2.1 Mandatory Waivers:
Prior to participating in any Activities at Wall Walkers Bouldering, all participants must complete and sign our comprehensive liability waiver. This waiver:

  • Must be completed truthfully and accurately
  • Remains valid and binding for all future visits
  • Must be completed by a parent or legal guardian for participants under 18 years of age
  • May require periodic renewal or updating

5.2.2 24-Hour Access Requirements:
Members seeking 24-hour access must complete an additional specific waiver acknowledging and accepting the increased risks associated with unsupervised climbing during non-staffed hours.

5.2.3 Waiver Effect:
By signing the waiver(s), you agree to release Wall Walkers Bouldering from liability for personal injury, death, or property damage resulting from the inherent risks of the Activities or the ordinary negligence of Wall Walkers Bouldering, to the extent permitted by law.

6. Cancellation and Refund Policy

6.1 General Cancellation Terms

All cancellations must be submitted in writing no less than twenty-four (24) hours prior to the scheduled service or activity. The notice period commences upon confirmed receipt by Wall Walkers Bouldering.

Failure to provide sufficient notice will result in forfeiture of any fees paid. All deposits paid to Wall Walkers Bouldering are non-refundable except where required by law.

6.2 Program-Specific Cancellation Terms

Memberships may be cancelled at any time by providing written notice. Cancellation processing requires up to three (3) business days from receipt of written notice.

Program credits are valid only for the period specified in program terms and are non-transferable and non-refundable except where required by law.

Private coaching cancellations require minimum twenty-four (24) hours notice. Late cancellations or no-shows incur the full session fee.

7. Payment and Pricing

7.1 Fees and Charges

Wall Walkers Bouldering reserves the right to modify its published rates at any time without prior notice. A surcharge of 2.2% applies to all credit card transactions, and a peak hours surcharge of 10% applies to group bookings during designated peak periods.

7.2 Payment Terms and Methods

Wall Walkers Bouldering accepts payment via credit and debit cards issued by major financial institutions. Membership fees and recurring charges will be automatically processed using the payment method provided by the member.

Wall Walkers Bouldering implements industry-standard security measures to protect payment information. All electronic payment processing is conducted through secure, PCI-compliant payment gateways.

8. Youth Programs

8.1 General Enrollment Conditions

Wall Walkers Bouldering provides specialized programs for youth participants aged five (5) to seventeen (17) years. Program enrollments are processed on a first-come, first-served basis, and full payment of program fees is required prior to commencement. A parent or legal guardian must attend the first class session for mandatory orientation and safety briefing, during which all required forms and waivers must be completed before participation commences. Initial assessment of climbing ability may be conducted at the discretion of Wall Walkers Bouldering staff.

Participants are required to wear appropriate climbing attire that allows full range of motion, including properly fitted climbing shoes, which are available for rent. For safety purposes, loose jewelry, accessories, or items that could pose a safety risk are strictly prohibited, and long hair must be secured. Personal chalk bags are recommended but not required for participation.

8.2 YouthFam Program Terms

The YouthFam Program operates on a term-by-term basis wherein program participation is restricted by age groups. Thursday sessions accommodate participants aged seven (7) to ten (10) years, while Saturday sessions are designed for participants aged seven (7) to twelve (12) years.

Regarding attendance and credits, participants are eligible for credits for a maximum of two (2) missed classes per term. Such credits are exclusively valid for the immediately following term and will be applied as a direct deduction from the next term's enrollment fee. It is hereby noted that credits are non-transferable and only valid for re-enrolling students. All credit claims must be submitted within one week of the missed class. The aforementioned credit system is subject to proper notification of absence as specified in Section 8.5.

8.3 YouthSquad Program Terms

YouthSquad operates on a membership-based payment system. Equipment and gear hire are not included in the membership fee. Members may elect to pause their membership during school holiday periods, subject to written notification requirements outlined herein.

8.4 CompSquad Program Terms

CompSquad Program participation is limited to ten (10) children. Admission to the program is contingent upon satisfaction of at least one prerequisite criterion: completion of one term of Youth Squad or demonstrated significant climbing experience and interest, as determined by Wall Walkers Bouldering staff.

8.5 Program Administration and Conduct

Photography and video recording may be conducted during classes for promotional purposes. Parents or guardians must submit written notification if they do not consent to such media capture. Unauthorized photography or recording by participants or spectators is strictly prohibited. Wall Walkers Bouldering maintains the right to modify class content, adjust instructor assignments, and cancel classes due to insufficient enrollment, in which case a full refund shall be provided.

Participants shall adhere to a strict code of conduct including prompt compliance with instructor directions, respectful behavior toward fellow participants and staff, and adherence to all safety protocols. Disciplinary measures may be implemented for violations, ranging from verbal warnings to program dismissal, with no refund provided for disciplinary dismissals.

8.6 Parent/Guardian Obligations

Parents and guardians are required to maintain current emergency contact information and promptly notify staff of any medical conditions or concerns. A minimum of twenty-four (24) hours notice is required for any cancellations or schedule changes. Parents and guardians shall ensure timely drop-off and pick-up of participants and must provide written authorization for any alternate pick-up arrangements. Furthermore, parents and guardians are responsible for supervision of children outside of scheduled class times and must attend parent meetings or orientations as required by Wall Walkers Bouldering.

9. Conduct and Behavior

9.1 General Conduct Requirements

All persons entering Wall Walkers Bouldering facilities or participating in Wall Walkers Bouldering activities must conduct themselves in a responsible and respectful manner. The following conduct is strictly prohibited and may result in immediate removal from the facility:

  • Any form of harassment, discrimination, or intimidation
  • Unsafe climbing practices or behavior
  • Damage to or misuse of facility equipment or property
  • Use of profane or offensive language
  • Recording or photography without express permission
  • Any illegal activities or violations of applicable laws and regulations

9.2 Enforcement and Consequences

Wall Walkers Bouldering reserves the right to enforce these conduct requirements through:

  • Verbal or written warnings
  • Immediate removal from the facility
  • Suspension or termination of membership privileges
  • Ban from future entry or participation
  • Reporting to relevant authorities where applicable

10. Equipment and Facility Use

10.1 Equipment Provisions

Wall Walkers Bouldering provides certain equipment for use within the facility, subject to availability and current facility inventory. Users of Wall Walkers Bouldering equipment are required to:

  • Inspect all equipment before use
  • Report any damage or defects immediately to staff
  • Use equipment only for its intended purpose
  • Return all equipment to designated storage areas after use

10.2 Facility Access and Usage

All members must carry and present their membership cards when accessing the facility. Membership cards are non-transferable, and lost or damaged cards must be replaced at the member's expense.

Facility users must comply with:

  • All posted safety rules and warnings
  • Staff instructions and guidance
  • Designated area restrictions
  • Equipment usage guidelines
  • Maximum capacity limitations

11. Privacy and Data Protection

11.1 Personal Information Collection and Use

Wall Walkers Bouldering collects and maintains personal information including:

  • Contact details
  • Emergency contact information
  • Health and medical information relevant to climbing activities
  • Payment information
  • Usage and attendance records

11.2 Data Security and Protection

Wall Walkers Bouldering implements reasonable security measures to protect personal information. Wall Walkers Bouldering maintains CCTV surveillance systems that operate twenty-four (24) hours per day.

11.3 Data Access and Privacy Rights

Members may request access to their personal information held by Wall Walkers Bouldering, subject to reasonable notice requirements, verification of identity, and administrative fees where applicable.

11.4 Marketing Communications and Image Rights

By completing the Wall Walkers Bouldering waiver form, participants grant Wall Walkers Bouldering the right to:

  • Use and publish any photographs or video footage taken within our facility for marketing purposes
  • Process and utilize personal information for marketing and promotional communications

12. Group Bookings and Events

12.1 Booking Requirements

All group bookings and events must be submitted through the official Wall Walkers Bouldering booking system, accompanied by the required deposit payment, and confirmed in writing by Wall Walkers Bouldering staff.

12.2 Payment Terms

Non-refundable deposits are required to secure all bookings, and full payment must be received no later than seven (7) days prior to the event.

12.3 Facility Use Policies

Group bookings do not guarantee exclusive facility use unless explicitly stated in the booking agreement. Areas not included in the booking remain available for regular member use.

12.4 Event-Specific Terms

All group bookings and events must comply with:

  • Standard facility rules and safety requirements
  • Specific event guidelines provided by Wall Walkers Bouldering
  • Applicable laws and regulations
  • Noise and time restrictions

A Force Majeure Event means any event or circumstance beyond the reasonable control of Wall Walkers Bouldering, including but not limited to:

  • Natural disasters or severe weather events
  • Fire, flood, earthquake, or other natural disasters
  • Epidemic or pandemic
  • War, invasion, terrorism, or civil unrest
  • Government actions, laws, or regulations
  • Industrial disputes or strikes
  • Failure of essential services or utilities

14.2 Member Rights During Force Majeure

Where services are suspended due to a Force Majeure Event:

  • Membership terms may be adjusted or extended
  • Alternative services may be offered where feasible
  • Credits or adjustments will be determined at Wall Walkers Bouldering' discretion

15. Legal Jurisdiction and Notices

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Queensland, Australia, applicable Commonwealth legislation, and local government regulations of Brisbane City Council.

15.2 Copyright and Intellectual Property

All intellectual property rights in Wall Walkers Bouldering' materials are owned by Wall Walkers Bouldering Pty Ltd or its licensors and protected under Australian copyright law. No part of Wall Walkers Bouldering' intellectual property may be reproduced without express written permission.

15.3 Severability

If any provision of these Terms is found to be invalid or unenforceable, the provision shall be severed from these Terms, and the remaining provisions shall continue in full force and effect.

15.4 Entire Agreement

These Terms, together with any additional documents expressly incorporated by reference, constitute the entire agreement between Wall Walkers Bouldering and users of its facilities and services.

15.5 Consumer Rights

Nothing in these Terms shall exclude, restrict, or modify any rights under the Australian Consumer Law, limit any guarantees, warranties, or other rights which may be implied by law, or affect statutory guarantees under Queensland consumer protection laws.
