These Terms of Use govern your access to and use of Wall Walkers Bouldering's website, facilities, and services. By using our services, you agree to be bound by these terms and all applicable laws.

This agreement is legally binding under Australian Consumer Law and is subject to modification at our discretion. We recommend reviewing these terms regularly as they may be updated to reflect changes in our services or legal requirements.

By accessing our facilities or using our services, you acknowledge that you have:

• • Acknowledged the inherent risks associated with climbing activities
• • Provided accurate information in all registrations and waivers

For users under 18: A parent or legal guardian must review and accept these terms on your behalf, and must sign all required waivers and consent forms.

If you do not accept these terms, you may not access our facilities or use our services. We reserve the right to deny access or terminate services for non-compliance with these terms.

For the purposes of these terms:

• • "Activities" means all climbing, bouldering, training, and related activities offered at our facility
• • "Facility" refers to Wall Walkers Bouldering premises at Capalaba and any future locations
• • "Services" includes all programs, classes, coaching, equipment rental, and facility access
• • "Member" means any person who has purchased a membership or recurring access plan
• • "User" refers to any person accessing our facility, including members and casual visitors
• • "Equipment" includes all climbing holds, safety equipment, training apparatus, and facility infrastructure
• • "Class" means any scheduled group instruction, coaching session, or program offered at our facilities
• • "Class Credits" refers to credits that can be used toward future class bookings
• • "Visit Booking" means a timed reservation for facility access at a location where bookings are required or offered
• • "Advertiser" means any business or individual participating in our Advertising Partner Program
• • "Ad Content" refers to any promotional material submitted by Advertisers for display at our facilities
• • "Franchisee Portal" means the restricted online area accessible to approved franchise inquirers and franchisees

Operating Hours

• • Operating hours vary by location - please check our website or contact your local facility
• • 24/7 access available for eligible members with access cards
• • Holiday hours may vary - check our website for updates

Access Requirements

• • Valid membership or casual pass required for entry
• • Completed waiver and registration required before first use
• • Photo identification may be required for verification
• • Children under 16 must be accompanied by a parent/guardian unless enrolled in supervised programs

Safety Requirements

• • Mandatory safety briefing for first-time users
• • Appropriate climbing attire required (closed-toe shoes, comfortable clothing)
• • Climbing shoes must be worn on climbing surfaces
• • No climbing while under the influence of alcohol or drugs

By participating in Activities at our facility, you acknowledge and accept that:

• • Climbing involves inherent and obvious risks including but not limited to falls, equipment failure, and collision with other climbers
• • You participate voluntarily and at your own risk
• • You are responsible for your own safety and that of others around you
• • You will not hold Wall Walkers Bouldering liable for any injuries or damages

Required Waivers

• • Adults (18+): Must sign liability waiver before participating
• • Minors (under 18): Parent/guardian must sign waiver and consent forms
• • Group bookings: Individual waivers required for all participants
• • Digital waivers: Available online for convenience

Payment Methods

• • Credit/debit cards (Visa, Mastercard, American Express)
• • Direct debit for recurring memberships
• • Cash payments accepted for casual passes (subject to availability)
• • Digital payments via approved platforms

Pricing and Billing

• • All prices are in Australian Dollars (AUD) and include GST where applicable
• • Membership fees are billed according to your chosen billing cycle
• • Repeated missed Visit Bookings may result in no-show fees or pass forfeiture as set out in these terms
• • We reserve the right to modify rates with 30 days written notice
• • Failed payments may result in account suspension

Refund Policy

• • Nothing in this refund policy limits your rights under Australian Consumer Law
• • Casual passes are non-refundable once activated, used, expired, or partly used, except where required by law
• • Unactivated casual passes may be reviewed at Wall Walkers Bouldering's discretion, but are not refundable for change of mind
• • Memberships are billed for active facility access, not recorded attendance or usage
• • Membership cancellations must be submitted through the approved cancellation process and take effect at the end of the current paid billing period unless confirmed otherwise in writing
• • Cancellation does not waive outstanding fees, failed payments, or unpaid invoices
• • Access, bookings, purchases, or future memberships may be restricted until unpaid amounts are resolved
• • Prorated refunds are not automatic and may be considered at our discretion for genuine medical incapacity, relocation, or other exceptional circumstances, with supporting evidence required where appropriate
• • If Wall Walkers Bouldering cancels a class, customers will be offered a full refund, class credit, or rescheduling option
• • Customer class cancellations are handled under the class cancellation policy, including any notice period, credit, refund, or no-show rules shown at booking

Membership Pauses

• • Eligible active members earn 7 free pause days after each completed active membership month
• • Free pause days are earned retrospectively based on your membership start date, not calendar months
• • If your membership is paused at any point during a membership month, that membership month does not earn free pause days
• • You can bank up to 30 earned free pause days at a time
• • Pause days beyond your available free balance are charged at $1 per day before the pause is confirmed
• • Your member portal will show your available free pause days and any payable pause cost before you confirm a pause

Some Wall Walkers locations may require members and casual pass holders to reserve a timed Visit Booking before entry. Visit Bookings help manage capacity and keep access fair for other climbers.

Visit Booking Requirements

• • If a location requires bookings, you must hold a valid confirmed Visit Booking before accessing the facility
• • Visit Booking availability, booking windows, permitted durations, and cancellation cutoffs may vary by location
• • Cancelling before the applicable cancellation cutoff will not count as a no-show
• • Late cancellations and missed bookings may be recorded against your account reliability history

No-Show Policy

No-Show Penalties

• • Casual pass holders: repeated no-shows may cause the casual entry pass linked to the missed booking to be consumed or forfeited
• • Members: repeated no-shows may incur a $10 no-show fee charged to the default payment method on file
• • No-show history may be assessed on a rolling basis, and we may adjust thresholds or enforcement where necessary to protect fair facility access
• • We may restrict booking access, suspend account privileges, or refuse entry for repeated misuse of the booking system

Wall Walkers Bouldering offers various classes including climbing instruction, fitness programs, and youth programs. The following terms apply to all class bookings.

Class Registration

• • Classes may be booked online, in-person, or via phone
• • Some classes require prerequisite experience or age requirements
• • Class sizes are limited and bookings are confirmed on a first-come, first-served basis
• • Waitlist positions may be available for full classes

Cancellation Policy

Class Credits

• • Class credits are non-transferable and non-refundable for cash
• • Credits may be used for any class of equal or lesser value
• • Credit expiry periods may apply - check your account for details

Cancellations by Wall Walkers Bouldering

• • We reserve the right to cancel classes due to insufficient enrollment, instructor unavailability, or unforeseen circumstances
• • If we cancel a class, you will receive a full refund or class credits at your choice
• • We will make reasonable efforts to notify you of cancellations as early as possible

The following terms apply to independent instructors offering classes through Wall Walkers Bouldering.

Application and Onboarding

• • A non-refundable $50 AUD application fee applies to instructor applications
• • Applications may require qualifications, identity verification, and insurance documents
• • Wall Walkers Bouldering may approve or decline applications at its discretion

Platform Fees and Pricing

• • Instructors are charged a platform fee on each successful booking
• • The standard platform fee for new independent instructors is disclosed during application
• • Established instructors bringing a demonstrable pre-existing client base may request individually negotiated written terms
• • The applicable fee is recorded against the instructor profile and deducted prospectively from bookings
• • Instructors must comply with minimum class pricing requirements set by Wall Walkers Bouldering

Payments and Stripe Connect

• • Instructors must maintain an active Stripe Connect account to receive payouts
• • Platform fees are deducted automatically before payouts
• • Payout schedules and processing are subject to Stripe terms and timelines

Marketing and Contact Access

• • Instructors may access approved marketing campaigns to predefined Wall Walkers Bouldering segments
• • Instructors cannot export or directly view private contact lists
• • Spam, abusive messaging, or misuse of communication tools may result in suspension
• • Contact identity details are only available where permitted by attendance and platform policy

Activity and Compliance

• • Instructors must maintain activity standards to remain publicly listed
• • Wall Walkers Bouldering may hide, suspend, or remove inactive or non-compliant instructor profiles
• • Instructors are independent contractors and responsible for their own tax, insurance, and legal obligations

The following terms apply to businesses and individuals participating in our Advertising Partner Program.

Registration and Approval

• • Advertiser registration is subject to review and approval by Wall Walkers Bouldering
• • We reserve the right to reject applications at our discretion
• • Approved advertisers must maintain an active subscription to display content
• • You must provide accurate business information including company name, ABN (if applicable), and contact details

Content Guidelines

• • All ad content must be submitted for approval before display
• • Content must not be offensive, misleading, or in violation of any laws
• • Content must not promote competitors or conflicting services
• • We reserve the right to reject or remove any content at our discretion
• • Typical approval time is within 48 hours of submission

Content Ownership

• • You retain ownership of your submitted content
• • By submitting content, you grant Wall Walkers Bouldering a license to display it at our facilities
• • You warrant that you have the right to use all content submitted
• • You are responsible for ensuring your content does not infringe on third-party rights

Subscription and Payment

• • Advertising subscriptions are billed monthly via the payment method on file
• • You may cancel your subscription at any time with no lock-in contract
• • Upon cancellation, your ads will be removed at the end of the current billing period
• • No pro-rata refunds are provided for partial months

Account Suspension

• • We may suspend advertiser accounts for violation of these terms
• • Suspended accounts will have all content immediately removed from display
• • You will be notified of the reason for suspension and may appeal the decision

The following terms apply to users accessing the Franchisee Portal, including prospective franchisees and approved franchise partners.

Portal Access

• • Portal access is granted to individuals who have expressed genuine interest in franchise opportunities
• • Access credentials are personal and must not be shared with others
• • We may revoke portal access at any time at our discretion

Confidentiality

Use of Information

• • Portal information is provided solely for evaluating franchise opportunities
• • You may not use portal information for competitive purposes
• • Financial projections and performance data are indicative only and not guarantees

Franchise Agreements

These website terms govern your use of the portal only. Actual franchise relationships are governed by separate legal agreements including Franchise Disclosure Documents and Franchise Agreements, which will be provided during the formal application process.

Modifications

Governing Law

These Terms of Use are governed by the laws of Queensland, Australia. Any disputes arising from these terms or use of our services will be subject to the exclusive jurisdiction of Queensland courts.
